  • Charging Order, second dip?

    Hi all. I'm back after an age....Back in 2008 we had several charging orders on our house from various creditors right before the financial crash. Rather than making the orders final a couple of them agreed to lift their orders to allow the property to be sold (the mortgage company were also seeking to repossess but didn’t as we found a buyer). The creditors have taken no further enforcement action in the intervening fifteen years. I know they could apply for permission to enforce their ccj’s at any point, but what’s the chances of their application being successful, and could they apply for a charge on my current property?

    I would say that after all this time it is possible but unlikely - but I can offer no guarantees.

    When did you last have any communication from these creditors?

      Thank you for your reply. I’m honestly not sure. I may have received the odd statement or two over the years, but no serious attempt at communication. The most recent was a text message advising me that I’d been sent a letter, which I thought was odd. The letter (from Cabot) apparently is advising me that the account is no longer on hold

            I do seem to remember letters coming through offering full and final settlement figures as low as 20%. I just binned them as being desperate attempts to collect
