  • Can’t get paid CcJ removed from file - Cabot

    Looking for some help with removal of CCJ from records so we can remortgage. We had a court order charge over 10 years ago with Northern Rock loan, we finished paying in full to Mortimer Clark > 12 months ago and received a letter to confirm settlement.

    We’re now having trouble remortgaging as the CCj is still on record. We’ve been trying to get it resolved for 5 months now, we’ve being bounced between the courts, Mortimer Clark and Cabot but nobody seems to be able to sort, we just get told to wait then we hear nothing.

    Looking back at the correspondence it seems Cabot changed our cus ref number at some point so we think this has caused the issue but Cabot are not coming back to us even though we’ve raised a formal complaint with them.

    any thoughts on how we fast track? We’re paying extortionate interest on our mortgage until we can secure the new mortgage fixed rate offer we have received.

    Just to clarify the issue is that the claim number on the paperwork from Mortimer Clark confirming full payment is different to the claim number on the final charging order paperwork so the county court cannot match it.

      Hi

      I'm struggling to understand your question. A CCJ is usually recorded on the Registry trust register and on your credit file for 6 years then it is removed, so I'm not sure why after 10 years the CCJ is still appearing on your credit file or the Registry Trust register.

      Are you able to confirm that you are indeed talking about a CCJ, or do you mean the charging order which would be recorded on your property title?

            Quick update, having just chased Cabot again they have now confirmed that they did have an error in their claim numbers and are happy that the C5 was satisfied so they are currently instructing Mortimer Clarke Solicitors to remove the charge.. it’s taken 3 months for them to confirm this!
