  • Adverse Possession - opening garage door over someone else's land

    Hi, half the land (grassy verge) in front of my garage is owned by Highways and the other half is owned by the Estate of a local farming family. One garage door opens over Highways' land and the other door opens over the Estate's land. Our family have owned the garage for c. 50 years, originally bought from the local council with the right of access. The doors fold and pin back effectively preventing anyone else, including the landowners, from using the land outside the garage, so we park our car outside the garage. No one has ever challenged this. My understanding is that I can't claim an easement because I am depriving the owners of the total use of that piece of land, but I might be able to claim adverse possession. What do I need to do to get Adverse Possession. What could this fail on?

    The layout you describe is not 100% clear, but it does not provide exclusive possession, and therefore will not support a claim for adverse possession.
