  • Letter received from Debt Recovery Plus - no previous correspondence

I have received a notice from debt recovery plus - first I have heard of a parking charge (nothing else received on this) - it is for parking with no permit in a small local shopping retail area. They are requesting £170.00 and said I have not responded to previous letters (I've never received any previous correspondence from anybody relating to this) - the date of the parking charge was apparently first week in January 2023 and DCP issued this notice on the penultimate day of February 2023. I've not received any photographic evidence of anything and this is nearly 2 months ago, I use this retail area very frequently and after informing my friend today she advised that she was aware that a number of people appear to have been issued with these demands and directed me to a local neighbourhood app where people exchange experiences. It would appear from this neighbourhood app that a number of people have been issued with an actual parking notice which I've never received. This has meant that I've been unable to appeal as some of these people have against the allegation and indeed successfully. How should I take this forward I'm slightly confused as some sites say to ignore these letters and but I'm concerned as I've never appealed due to having no knowledge of this until now does this mean that my right to appeal is extinguished by the fact that I've never received any previous correspondence - surely that isn't right?

You can ignore Debt Recovery Plus for the time being, but you could send a Subject Access Request (template in SHORTCUTS panel on right) to the parking company to see what it is all about.

Hi Des8 - just to say I sent a subject access request and also a complaint to UK Carpark Management Ltd - they responded to my complaint saying that I'm too late to appeal by the normal route and and appeal to one of their trade bodies - see cut and paste below. However I have to pay £15.00 to appeal!!!!! - this seems so wrong - do you have advice on this - should I appeal down this route or not?

Given the circumstances you have advised within your correspondence. You have now been given the opportunity to engage using the IAS Non-Standard Appeals Service.

You will be given 21 days from the date of this notice to submit your appeal; all PCNs will be uploaded to the IAS website at the end of this working day.

You will be able to lodge your appeal by visiting www.theIAS.org. It should be noted that you will be required to make a non-refundable payment of £15.00 to the IAS to be able to proceed with your dispute.

        Not a flaming chance.
Not only do you have to pay, but you also have to agree to abide by the decision.

Just go back to them and tell them they have one month from date of your request to furnish you with the info required.
Warn them that failure to comply will result in them being reported to ICO
