  • Hello! What happens after Directions Questionnaire is filed

    Why didn’t I find this site before?
    Had a Money Claim Online begun against me for a fixed amount. I filed a defence and submitted a Counterclaim. Transferred to Small Claims Track.
    Both myself and Claimant filed Directions Questionnaire with Claimant filing a defence to my Counterclaim.
    Question ..... do I get the opportunity to reply to Claimant’s defence of my Counterclaim? If, so when and how? Claimant has refused Mediation.

    Im sure I’ll be here again to ask about presenting evidence and witness statements.

    The answer to your question is that the court will usually set a trial date and a timetable for things to be done before then so that the case is ready to be heard. Those things are likely to include:

    - disclosure of documents
    - exchange of witness statements
    - experts' reports (if required)

    You should deal with the defence to your counterclaim in your witness statements.
