  • Pcn issued at 22:34 for parking in white line outside my neighbour driveway

    • BADIS 7th February 2023, 19:16:PM
I was issued a PCN at 22:34 by Hounslow council enforcement agent
For parking on white line outside my next door neighbour driveway with his consent as he doesn’t own a car. But another neighbour didn’t like it complain to the council and this is how I got this pcn. Do you think I can appeal and win.

I do not think that it is in your neighbour's gift to waive your obligation to comply with laws about use of the public highway.

Actually that's not strictly true. You can park across a driveway as long as a) you have the residents permission and b) it is not a shared driveway.

Having said that if the OP continues to park there he's going to get more pcn's, since CEO's won't know he has permission. The white line (dog-bone) is only advisory.

Badis: you have the NtO. Did you challenge the original pcn and what was the councils response.

Post both your cahllenge and rejection

Post up the reverse side of the Notice. What was the issue date? (Date of sending the Notice).

I observe that the alleged contravention is not that you were parked across a driveway.

If you download the CEO Handbook here:

                              https://www.londoncouncils.gov.uk/se...il-enforcement

under code 27 it says quite clearly that this exemptio applies:

A vehicle parked outside a residential premises by or with
the consent of the occupier of the premises (but not in the
                              case of a shared driveway).

What is the date of the NtO?
