  • Section 21 Notice Validity

    Hi can anybody confirm or deny that a section 21 is invalidated if the landlord serving it is not Rent Smart Wales registered ?


    Rent smart have sugested this is the case but stated they are could not give legal advise and confirm this when asked.

    In Wales Landlords need to be licenced under the Housing (Wales) Act 2014, (or use an agent so licenced) .
    Failure to comply with the legislation is an offence and non-compliance may lead to criminal prosecution.

    So you cannot serve a valid Section 21 notice until the property is registered and either you are licensed or you use a licensed agent

      Hi Des8,

      Many thanks for the reply, The Agent is Licensed, Hower the landlord in Wales should also be registered (doesn't need a licence if using an agent who is) but has to register. They are not and this is the reason for my question.

        Sorry for misreading, but yes an unregistered landlord cannot rely on a section 21 notice
