  • Erroneous Council Tax CCJ

    My daughter left her council house eighteen months ago. Naturally, her Council Tax Benefit stopped. However, she received demands for payment on the property she left, and despite many phone calls and emails proving her non-residence, the council involved took her to court and secured a CCJ on flawed evidence. This has now been resolved.
    She left the property as a matter of urgency and under extremely stressful circumstances. She has had to grapple with the council blatently, or incompetently harassing her for money she didn’t owe, as well as having non-payment marked on her credit rating. Is she entitled to compensation?

    Had she gone to court it would have been resolved in the corridor with the council - that is what usually happens when the council are in the wrong. The CCJ would have been avoided. I doubt that compensation is payable, sorry. Other members may of course have a different point of view and will hopefully comment.
