  • M&S trespass notice

Hi, please could I ask for help as I’m getting confused and not sure what to do
A week ago pop to MS while I was doing my shopping my son run away on my way to catch i run out from the store without paying.
a guy approached me and said that I didn’t pay I was trying to explain but he was so rude! He took me downstairs and in small office he asked for my ID and he took a picture. He said that better accept so the police don’t get involved otherwise I’ll get a criminal record. He gave me a paper that’s says tress notice and he hand write civil recovery. He said he doesn’t have copies of the letter on how they will use my information and he said that I might receive a penalty. He didn’t let me pay for the items. He said verbally that I’m banded from ms for 2 years! I couldn’t believe to my ears! Please could you advise me what should I do and act?

I am sorry for what happened to you.

You do nothing. A lot of what the security guard said is just nonsense, but the essential is that you are banned from M&S for 2 years.

Take no notice of any demand sent to you for money. The system for such recoveries is fundamentally broken, and any money sought is very likely to be uncollectable.

Thank you so much for your reply! I was thinking to call MS to ask them to lift the ban but on the other side I’m just thinking that I might make worst. I have a small local MS near to my area which I used to pop a lot and I have been thinking to go and ask as I know them but I feel embarrassed. Not sure if the have face registration in that MS. 2 years is long and I might forget one day and get in to the store what you will suggest me to do

        Hi LLRR
you could write to the M&S store and make a Subject Access Request and explain everything that has happened, for CCTV footage you may have to pay a small amount to pixilate out other members of the public, explain that you offered to pay but the security person refused.

Hardly worth the effort of writing as M&S will inevitably support their security guard.

For the next few months I would avoid the M&S store where the incident occurred.

If you are spotted in one of their stores, as long as you are not doing anything wrong, all they can do is ask you to leave.
If you refuse they may use sufficient force to eject you.
