  • without notice application

I have received notice that a hearing has been set, to hear a without notice application by the other side, I'm at a loss as to what I need to do.

Do you have copies of the application and supporting statement(s)?

      Hi ATTICUS
No all I got was a letter from the court with a date and time and to attend and the name of the application, I've been doing some reading and this kind of application is irrelevant in my case, no assets to freeze no injunction needed, I think it was done as a stalling tactic
Also, I made an application for Judgement in default because they had acknowledgement of service but failed to enter a defense, my application was returned because they had applied to have my claim struck out

          Hi Atticus,
Thanks for your reply, that's just it, I don't, I have very little knowledge of the legal system, CPR rules, I have read and read till it gets blurred, I rang the courts all they would tell me is that the defendant had made a strikeout application, I thought that I was supposed get copies of the application and evidence they rely on.

It is 'without notice' - therefore you do not get any paperwork. The range of things they can apply for by such means. is limited, and whatever is decided you will have a right to object later.
