  • Mesher order not being paid out, can we go back to court?

    My H was married once before and when they divorced, he was awarded 19% of the value of the house at the point their youngest child turned 18. The ex-W has spent the last few years making offers (like 80% under the value of the court order), demands that he pays the mortgage off (even though that’s not what the judge said he had to do) or says she will pay and then pulls out. So we have had 3 separate solicitors bills and when we get to the point where contracts can be exchanged for completion, she goes off the radar so our bill goes up chasing her. Can we go back to court to get a bigger share than 19% and ask that she has to pay all these costs as she is deliberately delaying everything just to cost us money?

    You are always free to ask, but you will have to show a clear change of circumstances making the original order no longer appropriate.

    I doubt entirely that a court would be interested in the wasted costs. It can be included in the background no doubt, but I doubt it will make a difference.
