  • Defending CCJ issued by Utility company - N244 'Set Aside' Court Hearing imminent

    Hi guys, this is my first foray and post within this forum and I would be hugely grateful for any advice.

    I am a small UK garment manufacturing business and found out (through a cold call) that a CCJ had been lodged against my business on 1 Aug 2022. I had never received ANY documentation or warning, in fact had been in constant and regular phone and email communication with the Utilities company disputing incorrect bills etc.

    I managed to obtain a synopsis of the CCJ from an online portal 'Registry Trust Online' and noticed that the address was incorrect (presumably explains why i hadn't received anything) together with the amount (which to this day, I have still not received a breakdown of related invoices and charges).

    The hearing is imminent (I am representing myself) and my question is, do i need to send copies of my evidence to the Utilities company solicitors? - These guys, by the way, are a huge company and 'heavy hitters'. Very much a 'David' and 'Goliath' situation here.

    Hi SMEDEBS

    a)You've applied for the set aside, you've got a Hearing date, is that correct.

    b)I would send the their solicitors evidence of the incorrect address, the fact that the amounts claimed by the energy company were incorrect and that you disputed it at the time with the energy company.

    c)I would also copy in the Court the same information and make the Court aware that the information has been sent to their solicitors.

    d)also ask the energy company for all the information they hold on your energy account.

      Thank you for taking the time to respond ECHAT11,

      a) Yes, correct, 'Set Aside' was applied for and hearing date is Monday 7th November 2022

      b) Sent the solicitors a copy of the N244 application but will now forward all the associated and submitted documentary evidence
      (all of which you listed)

      c) It is my understanding that the original court (CCBC - online) who I filed the N244 (Request to Set Aside) together with associated documentary evidence,
      had forwarded everything to the County Court where the hearing is being held?!.

      I'm not going to lie, a bit of a scary prospect this, dealing with any form of Legal processes (debt or otherwise) is not something I have previously had experience of, therefore certainly outside my comfort zone. This being said however, am determined to challenge and make a stand here, both on a point of principle, (not to mention 'fair play') and good, ethical business practice.

        Just give the Court a ring to confirm that they have, no harm in getting confirmation.

        Try not to get stressed over it, but be in control of the things you can control.
