  • Overtime with Salary

I recently accepted a new position with my employer and unbeknownst to me it was a Salary position. Even my offer letter says hourly. I fought back and HR refuses to change me back to hourly. The problem comes in that I hold a separate secondary position that is PRN and over and above my regular 40 hours. After fighting for a month they have finally approved me to work both positions, but I am being told I will only be paid at the regular hourly wage and not time and a half. Can they do this? This is a large corporation/hospital in Colorado so fighting them has been difficult already but I am not sure this is legal.

Hi kgower It sounds like you are working in the USA. I am sorry but we are a UK based legal advice forum and do not have any knowledge of USA employment law.

I have found what appears to be a state website that may be able to give you some information if you look through it and the various links they have.

    https://cdle.colorado.gov/wage-and-hour-laws

Sorry we cannot help further, best of luck.
If you would like a one-to-one expert consultation with me on your employment issue than I can be contacted by emailing admin@legalbeaglesgroup.com

I do not provide advice by PM although I may on occasion ask you to send me documents this way but any related advice will be provided back on your thread.

I do my best to provide good practical advice, however I do so without liability.
If you have any doubts then do please seek professional legal advice.
