  • Litigation Capacity in a divorce

    I have been trying to get a divorce for nearly 5 years now. Husband is deemed not to have litigation capacity due to a court case which I was advised to take that route. Official solicitor was brought on board. Husband has ignored all correspondence from my solicitor and the official solicitor. The Official Solicitor doesn't have the power to get a litigation loan on behalf of Husband. I have no contact with husband in all that time. I have found out he has gained his driving license back in the past 12 months. Does anyone know if court of protection will help or do I go the court of appeal to overturn the litigation capacity to which cost me a few thousand pounds.
