  • Builder's Disputes

    Extension not completed, Some Shoddy Workmanship but demanding complete payments now has started litigation claiming in excess of £10000.00 so has now instructed a solicitor. i need to send Defense and possibly Counter Claim. Has anyone had similar experience, please advice.

    You are not the first.

    You need to collate all your evidence. By the sounds of it you will be looking to construct (sorry!) a Defence setting out this claimant's failures/breaches of contract so as to explain why you say he is not entitled to the payment sought. You mention a counterclaim: is this for return of money over paid or cost of completing/fixing the work?

    You may need legal assistance. Do you have legal expenses cover with a home or motor or other insurance policy?

      Works should have been completed within 3 months. number of workmen not consistent on site, various excuses for failure to attend site \ leave early, specs ignored etc. Works still outstanding. In possession of letter from Claimant confirming outstanding works but refuses to return. Counter Claim is for cost of money overpaid, cost of completing\ fixing the works. Unfortunately no Legal expenses, Insurance does not cover Building dispute\work.
