  • Utility easement//

Apologies as this is my first post but need some advice.

Our property lies between fields, a road (then our house) a canal and then a nature park. A company is planning on installing a new 12" gas main to connect to a major local business. From what we can gather the proposed pipeline is going to run under the farmers fields then run under the road through our garden under the canal and through the nature park to the business. The problem we have is that due to an existing gas main and geological constraints the pipeline has to run under our garden. There is nowhere else for miles in either direction for this pipeline to go. They are talking about compulsory purchase to enforce an easement on our garden. Appreciate that the pipeline will be installed using trenchless system but we didnt buy the property to have a gas main running through it. The other issue is that the installation compound for the trenchless system is going to be no more then 20 metres from our front door and the work will take a minimum of six months to complete plus 24 hour drilling.

would our garden constitute a ransom strip as our understanding is that the end user of the gas supply plans to further develop their site (and other local businesses?

We are going to seek proper legal advice but can we refuse the pipeline going through our garden - any advice gratefully received. This isnt about compensation or money either
    regards

If it is compulsory purchase, you will have no choice. Get a proper valuer whose fees will be paid by the purchaser. Make all tthese points to him.
Would this installation restrict the development of your own property?

Thank you for the reply - the whole thing is early days yet but compulsory purchase has been mentioned already. The installation would restrict development as the easement width would be 12mtrs restricting a large part of the garden. Time will tell but i think we are on a hiding to nothing with this. Our property is the only residential property that the pipeline is going to go through which is annoying to say the least
