    Hi,

    I just signed up here after reading positive reviews via Google.

    I had a personal Virgin card that got into debt when my business was completely destroyed during the Coronavirus outbreak. I have been unable to pay due to suffering with depression after the total collapse of my business and the debts I have built up because of this. I have a long history of depression and all the stress I have been going through really has not helped. My debt was firstly assigned to Arrow Global for collection. This has now been passed to Drydensfairfax Solicitors whom have since issued a CCJ in the Northampton court for full payment plus costs.

    I have looked into other threads and seen that many people have successfully defended claims that have been resold when a person suffers with depression. Therefore, I am looking for some help on how to get started please?

    Hi,

    I’m curious as to what threads you have been reading because depression alone is not a defence to a debt. Whilst the court might sympathise with your situation, if you incurred the debt and there is no other legal defence as to why you shouldn’t pay the debt, the court will give judgment against you.

    There may be other defences available but that depends on whether you engaged with Virgin or just stuck your head in the sand hoping it might go away until the court claim came through.

    Also, creditors have certain obligations and duties towards debtors who are vulnerable but I’m not sure what defence you have (if any) based on what you have posted.
