  • Letters to a judge

    Hi,

    New to the forums, just looking for an answer or two. Does anyone know if a witness (with a vested interest in one side) is allowed to write a private ketter to the presiding judge during a trial (one in which both sides are suing each other over various matters). If so, I presume the judge would have to inform the other side that such a letter had been received). Would the act of writing the letter be considered as an attempt to pervert the course of justice, obviously depending on the contents of the letter. Hope that makes sense.

    He can write in the sense that nobody is stopping him, but as you say, the contents of such a letter might easily step over a line.
    The judge would reveal; the letter to both sides and agree what to do.
    No such thing here as a private letter.

      Do the representatives of all parties know of your vested interest?

        I am not the witness concerned; the case is from several years ago, The witness has told me that his letter was decisive, probably just wishful thinking, although he was a person of considerable importance during his career. Thanks for the reply.

              I doubt that any Judge would receive such letters as his post would be screened before he receives it. If it concerned a case he was involved in, then he could choose not to read it and leave it on file until after the case has concluded. If you know, without a doubt, that a Judge has received a letter and taken certain action on the information, then do report it, but I doubt you would know that.
