  • Court claim - Expert witness report

    Good morning. I am a defendant and counter claimant in a civil court case following a painter causing damage to my roof resulting in smashed tiles and ingress of water. The expert witness has now issued his report and, not only upholds my statement, but has pointed out several other problem that I had not noticed initially. This means that my initial counter claim is significantly lower than it should be. Where do I go from here? Do I increase my counter claim or should I start another claim. It should be pointed out that the full extent of the damage cannot be ascertain until scaffolding is erected and this will not be done until after the court case. Please help. Thank you.

      Indeed. You may apply for permission to amend your counterclaim. echat11 has given appropriate links.
