    The claimant in a case that I am counterclaiming has refused mediation and has on several occasions missed deadlines set by the judge. Is this usual? And what impression is he giving to the court?

    Refusing mediation has no affect on the hearing, but it could have consequences if costs are involved (but unlikely in small claims)
    Missed deadlines... depends on the reasons

    I note you have another thread, presumably on the same case?
    Best to keep to just one thread, even if question is about different aspects

      Thank you for your response and advice. The reasons for his delay are many and varied ranging from, he was away for a break to, after agreeing on an expert witness within the time frame and engaging the expert, he changed his mind after the deadline so I had to find another 3 experts for him to choose from. That said, an expert has now been engaged and has surveyed the damage the claimant has caused. Although the report has not yet been filed, on talking to the expert while on his survey he has pointed out several other problems that I had not been unaware of.
