  • Paper Order from Probate Registry

    2 executors, me and 1 other who can’t get on. I send Affidavit in response to warning on caveat. Prob Reg sent letter - would I accept paper order? Yes.
    Prob Reg paper order stated ‘on receipt of email…..’ from other executor, and ordered independent solicitor. Asked prob Reg for copy of email. Said in hands of solicitor. Asked solicitor. Can’t supply, ‘breach of confidentiality’. Asked solicitor for all communications, SAR, won’t supply: Legal privilege.
    Seems unfair, Had gone to hearing would have heard what other executor had to say and would have had right to reply.
    Any advice would be greatly appreciated. TIA.

    The hearing gave you a chance to manage matters but you chose not to attend. You could have asked for a delay if you could not make the date, but may now have to accept what the ruling was.
