  • Equality in financial consent order.

My wife and I are going through the process of divorce. We now have our Nisi but have hit problems in our Financial Consent order. We went to mediation and agreed an amount - but when we applied for a Consent Order it was rejected as being unfair. The background information - my wife was an immigrant without any assets whatsoever.- we have been married for ten years - all the assets are owned by me including a house which I have lived in for over forty years, and my savings and pensions.- my wife has not paid a single penny into the domestic pot and has spent most of her time staring at her mobile phone.- she doesn't cook, entertain, no domestic duties at all. So what might be considered a fair split - and if this is not accepted by the judge is there any alternative to get a clean break. It just seems so perplexing that we agreed a sum in mediation - was it worth the money and effort.

You need to be sen to be fair and from what you are indicating, you are not. Your wife has supported you for 40 years to enable your joint assets to grow to where they are today. Likewise your pension is a joint effort as it was built up from your work, whilst she supported you.

You will not get the final order util you are fair in your financial settlement and consider the efforts your wife has made throughout your married life.
