Hi, hope someone can shed some light.
We live in an end terrace in Scotland and our neighbors currently take their bins through our garden which we want to put a stop to.
Our deeds say
"There shall be granted in favour of each feuar a heritable and irredeemable servitude right of
access over those parts of the feuing area adjoining his feu for the purposes of maintaining,
repairing and renewing the buildings, (including the cleaning of windows and the boundary
walls, fences and hedges subject to the said servitude right of access being exercised at a
reasonable time and upon reasonable notice"
Are we in our rights to stop access?
Also as it states they must give notice can I ask them to return the key to the locked gate I gave them and only let them borrow it when they need access for maintenance?
