  • Vehicle taken and sold on without permission

    My vehicle which I insure and pay the finance on was lent to a third party temporarily The person sold my vehicle without my permission knowledge or consent I reported this to the police crime no issued I contracted Dvla who said it was not shown as stolen they had not been informed police located vehicle left it with the new keepers they put a pace order. My vehicle was not seized I still 7 months later I am insuring and paying the finance for a vehicle I do not have Poseidon of Help what can I do ?
    finance company have just issued a letter asking for settlement even though I have paid them and kept them and the insurance company informed What’s my posistion and why are the police not returning my vehicle to me the owner ?

    Ok so you have a vehicle on finance, you loan the vehicle to a third party, now did you have the right to do so under the terms of your agreement with the finance company?

    The reason why the vehicle hasnt been returned to you is because, i suspect, of the following reasons

    1) At the point you loaned the vehicle, you didnt own it if it was on finance.
    2) If the chap sold the vehicle, then there may well be a risk that the police took the view that this case was one which the Hire Purchase Act applied to, and in the circumstances good title passed from the seller to the buyer, and they now are the legitimate owner.

    Cases like this are often more complicated than they first seem, but that would be my initial thoughts
