  • HELP PLEASE! Short term leasing mileage issue with known company surely not legal !

    Hi all, I urgently need some advice. I entered into a 28-day rolling period car lease with auto horn with a mileage allowance of 1250 miles per month on returning the car after 4.5 months they have sent me an invoice for nearly £3000 saying I owe excess mileage fees although I am within the monthly limit! I have looked through the paperwork and it appears they do have a section that says the mileage is 1250 miles a month pro-rata'd daily! Bearing in mind I am well within the limit including going weeks in the 4.5 months without using it, but having to travel to Manchester from the southwest once every week meaning that day in particular is disproportionate. Could someone please advise if this is legal as it seems like a disgusting trick that surely can't have any legal grounds to be considered a fair term!

    Any advice/help is greatly appreciated. I have a young family and debt, an underhand £3k bill on a technicality is not something I can come close to affording at all. Please please help

      Hi Sam thanks for this but no it’s completely different. It was an early termination or anything like that it turns out they have a tracker in the car and they work out the annual mileage daily. Ie 15,000 a year or 41 miles daily they have charged me for every day I have driven over the 41 miles. Which seems like madness. I have never seen anything like it before it’s a complete con.

        I believe they are in breach I strongly believe that this is a breach of the Consumer Rights Act 2015 under unfair contract terms. “Does it create significant imbalance, contrary to the requirements of good faith, to the detriment of the consumer.” Furthermore no material loss has occurred to them as the mileage has not been exceeded when worked out on the metric that the rest of the industry adheres too. But could do with some advise

          can you post the exact wording of the contract regarding mileage?
