  • Disputing Settled claim amount

    Hi wonder if I can get some advice. My previous car insurance company recently settled a third party Claim made against me. I have very serious concerns that the third party exaggerated the repairs/replacement that was needed on their vehicle and the insurance company just paid and expect to recover all the costs from me (there is an all section £3000 excess on my claim and I’m at fault for loaning my car out). However I’m not saying I shouldn’t be paying anything it’s just the amount I’m Querying. The insurance Company sent me the invoice from the third-party saying it was their report, but there was no report it was just a price list. I asked for the report from their engineer who verified the works and I was ignored. They then told me that my complaint wasn’t upheld and that if I am dissatisfied I can complain to the financial ombusdman Is there any way that I can get all the details reports information from this claim?

      You could send your insurance company a SAR request they have 30 days to send you all the data on your policy. Make it a general request, you don't want them not giving you stuff that otherwise they would. Make sure you get Proof of Postage.

      Once you have the info, go through it. Lodge a formal complaint with the insurance company, follow their complaints protocols, then go to the FOS if you still aren't happy.

      You might be able to get data from the other party too, as they will have your personal details.

        Thank you for replying. I’ll get that sent off.
        Do you think I should offer a payment plan in the meantime? As I’m not disputing that I owe money it’s just the amount I owe. Even if I wasn’t going to dispute it I still won’t be able to pay the amount in full so would have to arrange a payment plan with them.

          I would wait until you've gone through the data. To delay the Payment Plan, you could lodge a complaint with the FOS today, they will give the insurance company 8 weeks to look into your complaint. Enough time to get the data and decide your next step, prove that the debt should not be as suggested by the insurance company or provide more details to the FOS.
