Hi we had a debt in 2009 , it did slip our minds as illness overtook our lives, heard nothing from the company at all... we sold our property to our sons, no problem , all charges were settled at the point of sale, now one of my sons want to go off on his own but the other son , a charge has appeared on the Land Registry dated the same date as the purchase date 2016, I have tracked down the company but they wont return my calls or emails, it is our Debt and not my sons fault, The company is not talking to us..How do I get this resolved... The Company who bought the Debt is Tessera Credit Services & they used Phoenix Recoveries to apply to the court for an Interim charging Order, we can not remember who we owe this to or for how much... Any help or advice will be greatly appreciated...

Firstly, you urgently need to contact the solicitors who handled the sale of the property to your sons in 2016. It looks like a charge was missed.
Pheonix Recoveries are who you should contact in regard to paying off the charge. Unless i am misunderstanding, they should be very keen to get some money in for their client.
If the company does not respond (which would be very peculiar) then you can iunvestigate making an application to the courts to remove the charge. Read here for some info: https://www.justice.gov.uk/courts/pr...l/rules/part73
From CAB: Paying off a charging order
If you pay off the amount you owe under the charging order, you can apply to the court for the order to be ‘discharged’ - this means the order doesn’t exist any more. Ask the court for a ‘certificate of satisfaction’ on your county court judgment and include evidence of payment.
You can use the certificate to get the Register of Judgments, Orders and Fines changed. This should make it easier for you to get credit.
It’s usual for creditors to tell the Land Registry that the interim and final charging orders have been discharged.

Hi thanks for that, we can not get Phoenix to respond to us, even my sons Solicitors have tried, if they wont talk to us, we dont know how much or even if there is anything outstand, On the soliciotrs form it states Phoenix recoveries, their address and at the bottom of the form it also states NIL Balance, I have a copy of the charging ordering which states Tessera Crredit services, emailed the Active Financial Director, he tells me, they no longer have an interestOriginally posted by ULA View PostComment

If no creditor steps forward to claim this charge, then you'll need to apply to the court to have the charge removed.
