  • Peculiar problem of recovering money. Please help. Of utmost importance.

    I am in search of a very specific problem. If answered with case laws it can be of great help. X, a person who wrongfully gained a particular amount from Y, has been acquitted from that particular case. Now that person has died even though that order was not challenged. The competent court that handled the matter, since it was a question of wrongful gain, dishonesty, cheating and money laundering, was in fact a criminal court. Now, even though the nature of the act is criminal, there is a also a civil liability. The person who lost the money, has not gained his money back, since it is impossible to punish a person who is dead and no-one can fill his shoes. But that wrongful loss which the person (Y) has been affected with remains unsolved, and you cannot ask for the amount from the estate of the deceased since it was a criminal matter and it is impossible to file a civil suit with the person (X) being dead. So is there any specific provision in law which deals with it, or any case that dealt with this? It would be of great help.
