  • VW Excess Charge - Debt Collector Letter

    I had an Audi on PCP which I voluntary terminated in December 2017.

    I received a letter from VW Financial Services requesting payment for damage to allow wheels and excess mileage.

    I contacted them and disputed the damage to the alloy wheels, which they cancelled from the account, however stated I still needed to pay for the excess mileage.

    I told them that the excess mileage was non-enforceable and I would not be paying.

    That was the last contact I had with VW Finance and received no more letters/ emails/ calls.

    Since this time, I have moved addresses and also married so changed my surname.

    I was then contacted by the new owner of my old address stating a letter had been sent to that address for me.

    I collected the letter and it is from Blake Morgan Solicitors stating they have been asked to collect the balance of £755.56 for 10,000 excess miles on behalf of VW Financial Services.

    I called Blake Morgan and enquired as to how many times they have tried to contact me to which they stated this was the first letter they had sent and were only instructed by VW the day before.

    My question is - I have heard nothing from VW for a period of just over 3 years, can they now request the outstanding balance from me despite not being in regular contact with me or warning with debt collection? Where do I stand with this?

    Debts are statue barred after 6 years. As to what they have and haven't done collection wise it seems they haven't followed pre-action protocols regarding the debt. What I would do, firstly don't speak to them over the phone, only communicate in writing. Secondly send VW a Subject Access Request, they have 30 days to provide all the data on the account. Make sure you get Proof of Postage. You can then evaluate what to do.
