  • What Constitutes A Breach of Restraining Order

    Trying to find out if defamatory comments made on social media about me but not to me can be classed as breach of a restraining order.

    An estranged family member was served with a two year restraining order for Harrassment Without Violence last year following a series of incidents the previous year, including repeatedly turning up at my home and shouting abuse, invading the property, malicious communications on social media and telephone.

    I have been monitoring their social media through an alternative account (we've mutually blocked accounts years ago) and today has seen a stream of comments about me and another family member who is protected by the same order which range from the unpleasant and into (I believe) libel territory.

    My question is therefore can the comments made by the subject of the order be classed as a breach or should I go through alternative channels to seek redress?

    There's more to the situation than this but I don't particularly want to revisit the details unless it would help.
