    Hello

    l am looking for some helpful advice
    I have received a letter as one of the executors of my late fathers estate
    the letter is a summons to the local magistrates court for a non-payment of council tax the some of £486 plus £50 court costs
    this is liability from the 1st of April 2021 till the 31st of March 2022
    my father died on 13th of July 2021
    The liability comes from an empty property which he jointly owned with his brother and late sister although he did not live there
    it seems he has been paying a third of the council tax on this property

    The property is in the hands of solicitors and in the process of being sold by auction and is the only asset of his estate

    could anyone tell me if as an executor of my late fathers estate I am liable for this amount

    advice would be gratefully appreciated

    The estate is liable and not you.

    Have you told the council that your father has died?

      Yes they have been notified in july
      after funeral costs and settling his affairs there is only his share of the property left in estate

      the property has has been in dispute with his brother who has been refusing to sell for 18 years
      it is in the hands of solicitors who are trying to force the sale by auction

        So point them at the person still living in the property.
