My granddaughter was removed by text from a training course citing that she was not mentally stable. The company concerned had no meetings with her to discuss the situation. We did a DSAR and they had literally nothing in writing. They also deleted held data after we made the DSAR. The contract to attend the Academy has many points they have breached, There are supposed to be regular reports and it very specifically says if training is withdrawn for any reason they will look to transfer the trainee. They breached their own contract over and over again. The manager also allowed the trainees to consume alcohol during work and the Academy serves the public (it's a Barbering Academy!). They have also lied about my Granddaughter on various fronts, all of which we managed to prove with screenshots of social media posts and texts. We wrote to the company and asked them dozens of questions (very uncomfortable for them of course) and they have refused to answer any of them say it's not in anyone's interest to answer them! Just wanted some thoughts if possible. We are looking to take legal action against them as it seems to me in this day and age if you cite "not being mentally stable" as being the reasons for removing someone from a training program a) it's very ill advised and b) you would have to go through a lot of well documented processes - Thanks

Has your granddaughter been diagnosed with any health conditions by her GP or another health care professional?
If so, it could be that your granddaughter is covered by The Equality Act 2010

They gave no reason. "after the fact" they have backpedalled and said "their use of language was clumsy" and that they let her go after several warning about her behaviour. But this is all after the fact and there were no warnings ever given. Also 5 days before her removal they posted on Social Media saying what great work se was doing (We screenshotted this). When we made a DSAR they removed all traces of her from online. No she has not been diagnosed. She is a very normal 18 year old!

They just lied over and over. The manager even claimed they had no Whattsapp messages that we asked for because my granddaughter messaged the manager so much that she had to block her and delete all the messages. We know this is also a lie as a) we screenshotted everything (a total of 6 messages - 3 from each party) and b) when I made a formal complaint, My Granddaughter messaged the manager in question and it was sent, delivered and read (something that cant happened if a user is blocked by another). It is just lie after lie and all in black and white.

A barbering course.
Government paying a private company.
She completed 5 weeks of an 8 week course.
And literally 48 hours before they were still collecting ongoing paperwork from her (Passport, NI etc) and then out of the blue she gets this text saying you are off of the course because you are not mentally stable.
Also there is a 2 week probation period which she passed (apparently) as yet again they kept no records of anything, It's a big company too, which to me is incredible that they have lied, given students alcohol in the work place etc.
The claim we are looking at would potentially be breach of contract, denial of opportunity and discrimination. Thank you for your time by the way.

I think you mean hairdressing course (don't mention barbering course to your granddaughter). I think their finances might of hit the buffers. Has anybody else on the course been removed?
Before thinking about court, what you need to do is raise a formal complaint with 'the company' in writing, they will have a complaints process in place, you need to follow it even if it doesn't get you anywhere (courts need to see that you've tried everything to resolve the matter before you turn to them). There will also be a Government Department you can complain to, as they are being funded by the Government. Only communicate in writing, make sure you get Proof of Postage.

Thank you for this. It is actually specifically listed as a Barbering Course (not sure why). Have done everything you suggested. Registered our concerns within 24 hours and made a DSAR. They deleted everything from social media, text messages etc, but we screenshotted them all before they did this. They have refused to answer any questions stating them answering us would not be in anyones interest! I believe others were removed yes. Made a formal complaint that they also refused to answer. Have also done everything in writing, both by email with physical copies following "signed for". Will definitely investigate the Govt side of things. Just out of interest if we went public would that potentially harm a civil case against them? Thank you again.

I personally don't think it would matter, but you lose the element of surprise. Thank you again. We will keep it private for now. I looked into the Education & Skills Funding Agency and we have done everything they require for us to take it to them, so that looks like the next step. From my point of view, it's not going to go away, so step by step we will do whatever it takes (legally of course). I don't think the company have done themselves any favours by refusing to engage us, but that will ultimately be on them.
