  • PPI claimed by ex husband

    In 2002 my husband and I separated and I divorced him. In the settlement I got to keep the house that was in joint names both on the mortgage and deeds. He got to keep his RAF pension. The courts ordered him to carry on the payments for the mortgage and remortgage. (The remortgage was taken out behind my back in both names after he forged my signature) He kept up the payments for a couple of years then stopped paying. I managed to keep up the payments for a couple of years but then failed as I had 2 young daughters and despite working 7 days a week had to sell the house before it was repossessed. A week before Christmas I received an email from a PPI company saying that the PPI on the joint mortgage had been claimed in 2013 by my ex husband and that he’d received nearly £6000. I was never consulted about this despite the fact he’d left the house in 2002. I never signed anything. Should I have signed too if the mortgage was in both names? If so is there anything I can do regarding the fact that if my signature was required then it must have been forged?!

    Generally speaking, for accounts that were held jointly by a married couple that are then divorced, either party can only claim their share (ie 50% of the total of any PPI paid)

    However I'm a bit confused as to why the PPI company are informing you of this after so long. Are they pursuing you for commission? If so who is the PPI company?

      I went to a PPI company during the PPI claim period and they came up with a list of accounts I’d held. 1 bring the mortgage. I did say I was leaving that one as I thought he’d be awkward over it as he’s played some dirty games over the years. Out of the blue the other week they said C&G had responded and they the PPI had been redeemed. They forwarded me the letter they’d received from C&G to my ex husband. I have all the mortgage paperwork still proving it was in both names. By the amount he’d received I think he claimed both ours. This is a man that had been paying for life insurance on me for years behind my back as I’m a former cancer sufferer. The fraud team investigated that as I found out only by chance as he stopped the payment suddenly and they tracked me down x

        Ok but I'm still confused as to why the PPI company have contacted you with this information now. Are they asking you for payment for their commission?

        It would be helpful to see the letter from the PPI company and the letter from C&G if you could post them up redacting any personal info.

                Was the C&G letter addressed to you, your ex or both?

                We need to find out who signed the letter of authority for Gladstone Brookes to act for whoever it was and also who the PPI refund was paid to.

                I would advise that you send a Subject Access Request to both C&G and Gladstone Brookes - template here LegalBeagles

                Where the template says if there's anything specific to ask for, for the C&G one say ''Please include all signed contractual agreements and Letters of Authority''. On the C&G one put ''Please include all Letters of Authority and correspondence with any claims management companies''.

                They should respond within 30 days so let us know when they have.

                  I have just rung C&G as I rang before Christmas to ask about the claim my ex had made and they’ve informed me they won’t investigate as the mortgage was in his name 100% I have the paperwork still with both names on. It was a joint mortgage. He’s told me to make a complaint to the Mortgage ombudsman.

                    Ok well done. I would send the SARs in any event.

                    Usually Ombudsman services will only accept complaints once you've had a written final response to your complaint from the mortgage company (or if they haven't responded to your complaint within 8 weeks) so you should check to see if they will accept it.
