  • High Value Gift sent by customer what is the law

So a customer has sent a gift that is of high value , to an employee 'Reciever ( reciever concerned personally addressed but directly via work address with a covering letter signed saying they want to give the gift to the person ( "receiver" of a watch and jewellery ) , they have included the original receipt and warranty for the items in their name ( the givers name) and the transferable guarantee. There is no inducement or bribery for services as non are available , The Business is a low value membership , The "receiver" works in a role that has no financial control or ability to offer goods services in lieu . Is this a legal gift ? contact with the giver has been attempted but no response has been received ?

Many people gain gifts from clients and the value of the item whilst it may raise eyebrows is fine provided it can not be shown the person giving the gift has not and will not gain any advantage due to it. .If there is no attempt of bribery they could hand over a gift of any value.

You should have procedures in place where such gifts can be recorded and maybe it is a good idea now to ensure all employees are spoken to so they know that all gifts must be declared and ensure they are aware of the bribarey act. There is plenty of information on the web.

You as the employer must also ensure that the client does not gain any advantage from the employee and that you also don’t intentionally or unintentionally allow the client to gain an advantage as the giving of the gift could subconsciously influence your decision making . If other employees are aware be careful in case they treat them better in hope they will receive a gift . In end though an innocent gift of any value is acceptable provided the intention is right .
