    my son had received the letter from the collection people last year during covid-19 stating that the car was over parked and they and sent initial letters and now we have to pay £160 or discount due to covid £130
    i replied back stating that i had not received any previous letter and any evidence that i was there.

    they did not reply but kept on sending letters to my son to pay now or will be taken to court
    Now i got a letter from country court business centre
    is this legit?
    also i got a letter from B W Legal, it's not late and can be settled?
    what should i do
    I am the owner of the car not my son but he gets the letter and i don't have access to his letters

        ostell can help, did you tell them you are the keeper of the car in your letters to them?

            i only replied to ask for evidence n where the letters were sent as i was not sure if the wrong the wrong details

            no i did not update who the keeper is, as was not sure to give that information

            could you please advice on the steps forward?

                  if i ignore it, will he be not summoned to court and accused of not updating who is the keeper?

                    But he is the main driver in the insurance policy
                    but the car is not longer there it's been scraped as it's engine got busted

                      If the claim is ignored then your son will lose by default. Then a CCJ on the credit reference agencies, difficulties getting finance, even getting a phone.

                      Status of the car now is irrelevant.

                      It's not a a summons, it's a civil claim and the process will continue on even if your son does not respond

                      You cannot respond in your name, it has to be your son.

                      A Summons for not updating would be issued by the DVLA and it is a criminal matter

                          BW legal have also sent a letter that it's not too late and we can respond to them and find out the options available to pay, what are you thoughts on this?

                          The letter was dated 19th Nov 2021, but i received it on 2nd Dec 2021, tired calling the court to update that i have received the claim form late, but no one replied and they closed for the day.

                          the weekend has come and i have lapsed the 14days to response.

                          i the claim form there is no section that states that i am not the owner , only 4 choices
                          if you admit the claim and want time to pay
                          if you admit part of the claim
                          if you dispute the whole claim and wish to claim against the claimant
                          if you need 28day rather than 14 day from the date of service to prepare your defence, or wish to contest the courts jurisdiction

                          which one should my son fill to update that he is not the owner and i am the owner?

                            Reasons for disputing the claim are sent in the defence, a document sent to the court later. Not the owner now is not a defence if your son was the owner at the time, or was he? you are confusing the issue saying you are the owner.

                            So if you want to fight the claim then pick that choice that disputes the claim and acknowledge the claim on line using the details and password on the form. This gives you 33 days form date of issue to get your defence to the court. Please read some other threads about court procedures.

                            If BWL are on the ball then you may find that the case has already been lost because the claim was not acknowledged within 14 days.

                            Again why were you answering letters addressed to your son?

                              why am I not getting any answer, you answering in form of open question. There are no suggestions or updates on what me or my son should do or how to challenge the case.

                              Secondly `let me clear your first concern, i am not answering letters addressed to my son but asking advice on his behalf as if the charged are to be charged that it should be to me as I was the owner of the car at the time they accused my par been parked at that place, but at any point no evidence have been given.

                              whom should the claim be summoned to.. the car owner or the person named as the main driver in that insurance?

                              is there an online database where i can look at the ref no and see the pictures?

                              i was the owner of the vehicle at the time they have accused my son of the offence

                              reading your other threads i saw that BWL court cases do not impact my credit report, now you are saying it will be a CCJ and impact my finance?
