  • How do I go about actually obtaining costs that the judge awarded?

    So I won a set aside hearing where the judge ordered that my costs be covered by the claimant (Lowell), but the judge added a stipulation that I have to apply for fee remission before December and only if that is rejected they have to pay. Or if I didn't apply the costs are no longer payable.

    So I applied the week after the judgement (October) and sent them the response from the court that said I am ineligible for fee remission. I have written to them a couple of times but they are just ignoring me, when I call them they just put me on hold for ages then say that no one is there who can assist me.

    They don't seem to care that they are in breach of a court order and are probably holding out for the main hearing which is in March. How do I go about actually obtaining the costs back?

    Write a Formal Letter of Complaint (email it to them), mark it as such. Explain that you have contacted them on several occasions (state the dates and times of contact if you can). Explain what you want to talk to them about, what you want them to do and when you want them to do it (set a date). Explain after that date you will lodge a complaint with the FOS and Lowell will have to pay the FOS £500 plus for looking into your complaint. See if that gets them moving.

      &/or warn them you are about to apply for a warrant of control and send the court enforcement officers in.
      This will also involve them paying your costs for the warrant
