  • Breach of Tomlin Order and Confidentiality


    We have a Tomlin Order in place to settle a long-standing partnership dispute. The claimant has breached the terms of the schedule which is confidential and is not filed with the court. We are considering applying to the court to lift the stay and enforce the claimant to comply with the terms. We have significant information as evidence of breach of contract but how do we prove the breaches to the court bearing in mind the confidentiality clause?

      It is hard to see how a Tomlin Order could be enforceable if the schedule is confidential from the court.
      Anyway, the court itself is frequently party to confidential orders and so I would interpret that the details of the schedule can be disclosed to the court without breaching the confidentiality of the other party.
      "Although scalar fields are Lorentz scalars, they may transform nontrivially under other symmetries, such as flavour or isospin. For example, the pion is invariant under the restricted Lorentz group, but is an isospin triplet (meaning it transforms like a three component vector under the SU(2) isospin symmetry). Furthermore, it picks up a negative phase under parity inversion, so it transforms nontrivially under the full Lorentz group; such particles are called pseudoscalar rather than scalar. Most mesons are pseudoscalar particles." (finally explained to a captivated Celestine by Professor Brian Cox on Wednesday 27th June 2012 )
