  • CCJ - 6 years+ enforcement.

    Hello,

    Acting on behalf of a family member.

    A CCJ is about to reach 6 years. It's a CC through Lowell and Mortimer Clarke. The defendant was paying £5 p/m up to and including July. Def was made redundant and is not looking to resume employment. Previous WOC was gained but never enforced. MC have agreed since August for 60-day reviews and there's no payment on the account. It is likely the defendant will not be working for some time up to and including a year or two now and therefore has no income and expenditure has been moved into another person name.

    Can someone give me a stance on this situation? Could and would MC enforce it after it being around for 6 years? The debt is around £900, I believe not due to be paid off for a good 15 years. The WOC was gained back in 2017, so a while ago and they never bothered to enforce as they knew she didn't have anything worth value.

    What should I do? It seems very stupid me having to email and ring MC every 60 days to say the same thing when they should understand by now the current situation.

    She has 3 CCJ's. Two of them expire in November (one of which won't be paid off until 2098, which is stupid as she won't be alive) and one next August. In one of them, the company never chased it after me going through the courts N245 (income and outcome) and we've not heard in around 5 years on that one. For the other one, it's legal and general. Currently seems pointless as that's the one with over 80 years to go on a £4k debt @ £6 a month.

    Hi MYSTERY

    You say 'it is likely the defendant will not be working for some time up to and including a year or two now and therefore has no income and expenditure'. You don't mention the circumstances i.e. health etc, nevertheless I would be tempted to write to all the Creditors, see if they are willing to 'write off' the debts as there is unlikely to be any income for the foreseeable future. You could amend the following template, if you do send get Proof of Postage -
