Hello all, recently some badly done building work has cost me £3000 to put right. I would like to take the builder to small claims. When i have taken advise from trading standards/citizens advice; they have asked me to write to him warning of my intensions. The letter (recorded delivery) has been returned, opened, stating he is not none at this address and was unsigned. All of his online marketing (6 different sites) and companies house details confirm this is his address, so how do i serve court papers if he denies living there and will presumably deny receiving any court paperwork? All help appreciated.

The trouble with recorded letters is that there is no requirement for the addressee to accept them.
A better way of sending what I think is a Letter before action is to post it first class with a free certificate of posting from post office.
When you initiate court action the court will serve the claim.
If he ignores it you will win your claim by default
