Hi, is there someone who could give me some advice please? At my wit's end. We were to complete on a house sale and purchase on Friday. It didn't happen. Our buyer and his lawyer knew on Thursday that it wasn't going ahead due to him failing ant money laundering checks. We were asked to sign the missives on Thursday and now are in a binding contract with our purchaser. How could he fail these checks as late in the process as this and be able to get a mortgage. Thank you

He failed to perform the AML checks when he signed you up as clients?
This is meant to be one of the essentials steps of the client sign up? If he did not do that and triggered a delay like this, then there could be serious consequences for his firm.
Or did something come up in the AML checks which triggered an investigation and that caused unforseen delays?

Hi, thanks for your reply. Our purchaser apparently cannot provide satisfactory evidence of where his deposit is coming from. His lawyer has asked him to send the money to his parents for them to then gift it back to him. He is refusing to do this as he says the money has been in his bank account for three years. If we had been told this in time, we would obv not signed the missives.

Ok, first things first - are you in a chain? What is your housing situation given the delay?
His solicitor should certainly have flagged up much earlier the failure of AML checks and further down the line there may be recourse against the firm - but he will lose his deposit to you.
The main issue now is whether this situation can be recovered to save the sale/ purchase.

Ok so you have a forward chain.
Try not to panic, I can assure you the law firm of your purchaser will be doing everything possible to make him see sense and comply with the AML checks. They will be very concerned because their insurer could end up meeting all costs of this mistake. I know this does not give you any reassurance on a Saturday night waiting for the firms to open on Monday. No problem at all, I came close to losing a sale in similar circumstances many years ago, I remember it painfully well, so i know how you are feeling right now. My completion was delayed but we got there a week later. Take care and let us know how you get on.
