  • CCJ Set Aside with consent from claimant

    Hi, My wife and I are in a tricky situation. We currently live in a house but also own and rent out via local authority a small flat.

    We are trying to move house and have just been declined our mortgage offer. This was a huge shock as we thought our credit was excellent. On investigation it turns out that the owner of the building of our flat has been trying to collect ground rent from us and a CCJ was issued on 11th June. We have paid this instantly but we knew nothing of the CCJ itself until today.

    I have spoken to the owner and he is happy to give consent for the CCJ to be set aside because as far as he is concerned the debt is settled.

    I have completed the N244 that basically says this and I am waiting on the owner to respond to my email confirming his consent. Is this the correct thing to do? Are there any other forms I should be completing?

    We need to resolve this as quickly as possible as we have sold our house and have offered on another. (We had another mortgage offered approved prior to June 11th but backed out).

    Any and all advice will be gratefully received.
