  • Court Claim from ex partner

    My ex is trying to claim back a car she bought me as a gift. I have received the claim form,
    including particulars of claim and response pack (served 17-08-21) and I intend to dispute the whole of the claim.

    I'm posting because I need help with the process and wonder whether that help is available here or should I contact a solicitor or C.A.B.?

    Acknowledge the claim using the details and password on the form. Nothing in the defence. This gives you 33 days from the date of issue to get your defence to the court.

      So what help do you require?

      first up respond that you will defend in full, but do not enter a defence yet.
      That will give you extra time to enter your defence

        The claim hasn't been issued online, there are details but no password that I can see.

          Thanks for the link I've had a quick skim and already feel a little more knowledgeable. I have filled out the acknowledgement of service but I'm unsure where to send it as the only reference to the court is the county court at Manchester, do I just google their address and send it there?
          Also should it be 1st class, recorded or special delivery?

          I will need help with my defence and to that end I'm willing to type up the letter before action and the particulars of claim if it helps you to give advice. Also I can type up my counters which I'm confident will prove the claim against me is false.

            The N9 response pack includes "notes for the defendant" which tells you when and where to send the forms.
            At the bottom of the "acknowledgment of service" sheet are directions for finding court details.

            Send first class with free certificate of posting from post office.
            Keep copies of all documents sent

            The more info you give, the better and easier it is to advise

              I have attached scans of the Letter Before Action and the Particulars of Claim. The exhibits mentioned are just the letter before action an email and a bank statement both relating to the purchase of the car.

                I have returned the acknowledgement of service and have the certificate of posting. I have also uploaded the LBA and Statement of Claim for your perusal along with a description of the supporting evidence.
                I now need to enter my defence using form N9B and this is where I could use some help having never done this before. Also which of the particulars of claim I should address as a lot of it seems like filler and bears no relevance to the actual claim for my car.
                My supporting evidence is in the form of text messages referring to amounts of money she spent on me which total the amount of the car purchase and personalised registration. Also messages asking me for an amount of money and offering to never contact me again and I can keep everything if I pay up. Am I safe to rely on these as a defence?
