  • Scaffolding errected whilst on holiday

    Next door is being removated for students and the owner lives abroad.
    during the early stages I told him and the builders that there was to be no scaffolding erected on my property.
    When I went away on Wednesday the builders asked my son if they could do some work in our garden to which he permitted. whilst he was out they passed 2 storey high scaffolding over and errected it on my decking.
    I arrived home on sunday to find fence panels damaged (3) decking is ruined having recently cleaned and stained, it is covered in building dust and other parts and ruined. the decking is prevented from use by the scaffolding and the weight has possibly damaged the frame.
    can I start removing it myself and what can i do since the ower is not answering his phone and lives in Turkey
    have tried contacting the police but 20 min wait and the phone died.

    Do not remove the scaffolding yourself as
    1) you need to be qualified
    2) you could find yourself facing a criminal damage charge

    The way forward is a letter to the scaffolders/builders telling them to remove it immediately as it was erected on your property without your permission as your son did not have appropriate authority to give permission.
    Also, even if he did have that authority permission is now withdrawn.
    You also require the area be cleansed and returned to the condition it was in prior to their erection of the scaffolding.
    You will also be checking the condition of the frame which you think might be damaged
    Warn them that failure to remove within 2 days and you will seek a court order and they will be liable for costs.

    Not worth bothering the police as it is solely a civil matter

      my wife is really upset and you advise has aided her calming..
      will have a letter ready to give to the builder first thing in the morning.
      really appreciate the fast response.

        Do you have pictures of the decking just before teh scaffolding was erected? How old is your son is he under 18?
