  • Access to my land?

    There is nothing whatsoever in the Land Registry entries or title plans for either my or my neighbour’s property that mentions any right of access they may have over my land. Nevertheless, for as long as we have lived her (35 years) there has been a gate in the party fence to the rear of our terraced houses which facilitates their access through my land. They control the lock on the gate. We have no need to access their land. They can access the rear of their own property by going through their own house of course, so going via our land is not crucial. I want to be aware of my legal rights in this matter, particularly as it’s coming up to 20 years since my current neighbour arrived.

    I would think that a Right of Way exists by prescription, and you will not be able to remove it without your neighbour's agreement
