  • Guidance on missing deadline for defending a counter claim

    Hi, I am in need of some help! We made a claim for building works and they have responded with a counter claim which has meant we have to complete a Directions Questionanaire (N181) and the option to file a defence to the counterclaim (N9B). We thought that both had the same submission deadline but it looks as though the deadline for the defence to the counterclaim has passed!!
    What are the implications of this and can we still submit this as the form link has now gone from the moneyclaim.gov.uk site.

    They can seek a Default Judgement as you have not filed your Defence to their Counter Claim. The best thing might be to ring the MCOL Helpdesk - Civil Money Claims Telephone: 0300 123 7050, explain that you want to file a Defence. At the same time see if the Defendant has sought a Default Judgement. Even if they have, get your Defence done and sent in, from my experience the court might still entertain it.
