  • Libel

    I am taking action against an individual who has posted a damning libel posting on an internet website. I see on here someone did this in the county court via small claims and was successful. I wish to do the same can anyone advise how to do this. Regards DJAlan

    I'm not sure where you saw that but you can't start libel proceedings in the county court without the written agreement of both parties.

    See Civil Procedure Rules Practice Direction 2.9 (1) PRACTICE DIRECTION 7A – HOW TO START PROCEEDINGS – THE CLAIM FORM - Civil Procedure Rules (justice.gov.uk)

    Even then the court will allocate it to the multi-track which is horrendously expensive and complex.

    My advice is unless you're wealthy and stupid, don't start libel proceedings.

      Ok thank you' it would appear then anyone anywhere can post libel against anyone and just get away with it. Seems pointless having a libel or defamation of character proceedings if no one can afford it
