  • Can a right of access be changed?

    Our house is very old. The deeds sate that the neighbour has a right of access through our garden. We've never been bothered because we drag their bins through for them and they neve come through. However, recently one of the members of the family has become verbally abusive and we think slashed our car tyre. My husband did not want to drag the bins through because of the aggressive behaviour, we have had the police round looking for him on occasion and we know that when he was younger, he was in a gang of lads that used to walk into people's back doors and frighten families (we know of one young mum with a baby who was terrified).

    1. The property has been rented out since we got here 7 years ago.
    2. The landlord isn't approachable at all. We have had problems with the properties that used to be linked (two family members had them) and we only got his phone number last year by coincidence from a mutual friend.
    3. We pay for all maintenance fence, both gates etc. and our party wall.
    4. If they do start walking through, it's a cobbled path, someone could easily trip.
    5. We have a dog and a child. The child (and my mum) has already been on the receiving end of the abusive neighbour.

    We would prefer for them not to come through at all. Does anyone know if a right of access be changed please?

    Afraid you won't get that easement removed

    I would suggest you keep a diary (date, time) of all instances of aggression and harassment.
    These can be reported to the police and also serve as a basis for a civil claim for harassment and a court injunction forbidding further such incidents

        Definitely going to keep a diary. Their 13 year old just walked up our drive (again, it's cobbled and if he falls - I know who they take legal action against!) and he's gone and egged our window for no reason at all. Frightened our 4 year old and little dog to death. I thought egging only happened in the 90's! Going to have to get a recording camera on our drive, the cars and the front of the house and document everything! Thank you again for your help.

          Cobbles... hmm, but a reasonable person would take extra care when crossing them, and if you keep them in good condition you would have a defence.
