  • Neighbour’s Scaffolding

    Hello. My neighbour is having extensive building works which have overrun by several months. They have now decided to replace their entire roof which will involve scaffolding on my property.
    I understand their rights to complete repairs. However I am also due to begin building an extension in September. The scaffolding will be in the way, and I’m concerned this will lead to delays with my building works. There have been so many delays next door that I do not believe they will be finished by September.
    Where do I stand from a legal point of view? I am not against them doing the work, it is the fact that the timing is so bad and I will suffer loss.

    Hi Hoppy

    Are they aware of September / your extension? You could draw up an agreement whereby they pay for any delays (workmen) to the start of your work. That will also give them a push to get the work done a bit quicker, so everyone is happy.

    I'm sure other members will answer the legalities directly.

      Thank you. Yes - I had thought about that but then wondered whether I would be able to enforce if they ignored the agreement. I would have to show loss. Financially, I would not be out of pocket but I could lose my builder and have to wait for quite a few months before starting the work. It would be so annoying.
