    Hi Everyone,

    I wonder if you anyone can advise on this.

    I have a CCJ from September 2018 due to a Virgin Money credit card debt with PRA Group.

    I only received the original claim letter with very little time to respond due to being on holiday when it arrived and it potentially arriving late because my address on the claim was not entirely correct.

    Having never been in this position before, I did not dispute the claim and wrongly thought that this would allow me to make payment arrangements with the claimant directly. The next communication I received was that the CCJ had been issued; I did not expect this.

    I satisfied the claim in full on June 9th 2020.

    I am now in a position where I must buy or rent a new property, and this is having an adverse effect on me. Is there any way that I would be able to help in setting this CCJ aside?

    Any help or advice will be greatly appreciated!

    You are unlikely to get the CCJ set aside.

    First, you satisfied the claim in 2020 and we are now into 2021. Applications need to be made promptly and that is taken into consideration when decided to set aside the judgment.

    Second, even if you got it set aside, the claim has been satisfied already so the court would have nothing to decide on.

    Third, you are trying to repair your credit file and that’s an abuse of process which the courts will not entertain. You would need to explain the reasons for getting it set aside and you telling the court that you want to rent or buy a property is not a sufficient reason.

    The only way you could try to get it set aside is by way of a consent order and you would need to reach out to Virgin to get them to agree, though they have zero obligation to do anything. I would then expect the court to question why it should be set aside and you are back to square one of explaining.

    Alternatively you can get a certificate of satisfaction by the court if you pay £15 and provide evidence of the debt paid off.
