  • close brothers/DMN ltd voluntary termination HELP

Hello to all im hoping someone can help, ive recently gave notice to close brothers that i wish to vt My vehicle and agreement with them , the vehicle had some cosmetic damage at the time of purchase , i suspect it was cleverly disguised my a forecourt wizard or similar, i didnt take photos at the time but instead just ignored it , i have read the terms regarding fair wear and tear policy and im worried about the huge bill for damages i may recieve after inspection, is there anyone who can give me some advice about my legal standing regarding this and do i have to pay it? i gave notice to the finance company today 18/05/21 and recieved an email back confirming dmn are now handling the vt going forwards, i thought that i wouldnt be liable for any costs as im over 50% through my term (CB have confirmed this) but have still said in their email that damages above normal wear and tear are chargable , please help im a single female and suffering from long term health problems which are subsequently getting worse as a result of worrying about the stories ive read .
    thankyou in advance

    Hello

If you have read similar stories then you will know there is no magic cure for resolving this. Finance companies will either look to recover charges or they won't and it is up to you whether you agree or disagree with what they are claiming. If you are suffering from ill-health and this issue is contributing to it then I would suggest you look at coming to an agreement to repay what they're charging or if you don't want to do that, keep on fighting the charges. I've yet to see a finance company take someone to court over charges only, because the onus is on them to prove the damage was caused in your possession and that hurdle is likely to be near impossible to overcome for CB without photographic evidence.
If you have a question about the voluntary termination process, please read this guide first, as it should have all the answers you need. Please do not hijack another person's thread as I will not respond to you
